I follow oil/gas royalty cases quite closely and I wanted to let you know about a recently certified class action out of Oklahoma. The case is styled Beer et al v. XTO Energy. The plaintiffs sued XTO claiming that XTO was shortchanging them on their royalty payments. The plaintiffs were owed royalty payments for natural gas liquids extracted and sold by XTO. Instead of selling the gas on the open market, XTO sold the gas to a wholly owned subsidiary, Timberland, at a 15-20% discount. Timberland then turned around and sold the gas on the open market for a greater price. The class was certified but no settlement has been announced.
