Statutes of Limitations

I am frequently asked what the statute of limitations is for certain cases. The statute of limitations is the amount of time you have to bring your claim. Please be advised that the area of limitations can be very complicated and can be affected by many factors including concealment and discovery. You MUST consult an attorney to find out the specific laws that may affect your statute of limitations. However statutes of limitations in Texas are:

  1. Breach of duty of good faith and fair dealing in denial of insurance coverage: 2 years.
  2. Breach of fiduciary duty: 4 years.
  3. Wrongful Death: 2 years. (Note: Minor tolling provision does not apply. Discovery rule DOES NOT apply.)
  4. Fraud: 4 years from date of false representation or omission.
  5. Legal Malpractice: 2 years. (Discovery rule applies.)
  6. Negligent misrepresentation: 2 years.
  7. Libel: 1 year.
  8. Products liability: 2 years.
  9. Negligence: 2 years.
  10. Suit against architect, engineer, interior designer, or landscape architect who designs plans or inspects the construction of improvements or equipment attached to real property: 10 years.
  11. Tortious interference with business relationship: 2 years
  12. Deceptive Trade Practices: 2 years.
  13. Breach of Contract: 4 years.
  14. Misappropriation of Trade Secrets: 3 years.
  15. Liability of corporate directors: 2 years.
